Terms of Use & Copyright Notice
1. Who we are and what these terms cover
This website, bromboks.com (the “Site”), is operated by the artist and site owner known as KnoXXsiC (“we”, “us”, “our”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site. Contact: info@bromboks.com.
2. Ownership
Unless stated otherwise, the compositions, lyrics, arrangements, performances, recordings, artwork, text, logos and site design on the Site (together, the “Works”) are created, written and produced by KnoXXsiC, who owns, or holds the licences to, the rights in them.
Transparency about how the Works are made: some tracks and some artwork were made with the help of AI-assisted tools and with licensed sample or loop material. Those components are used under the terms of the relevant tool or licence. Third-party components such as fonts and software libraries remain the property of their owners and are used under their own licences.
The Works are protected by copyright and related rights under the law of the Republic of South Africa (including the Copyright Act 98 of 1978) and, through international treaties such as the Berne Convention, the TRIPS Agreement and the WIPO Copyright Treaty, in most other countries. All rights not expressly granted in these Terms are reserved.
3. What you may do
We give you a limited, non-exclusive, non-transferable, revocable licence to:
- stream and listen to the Works through the Site for your own personal, non-commercial enjoyment; and
- link to pages of the Site.
4. What you may not do
Without our prior written permission you may not:
- download, rip, record, capture, copy or store the audio, or use any tool to do so;
- upload, re-upload, redistribute, sell, rent, broadcast, stream or publicly perform the Works, in whole or in part, on any other site, platform, service or place;
- use the Works commercially or in any other production — including video, film, advertising, games, apps, podcasts, livestreams, social-media content or background music for a business (“synchronisation” use);
- sample, remix, cover, adapt, translate or create derivative works from the Works;
- use the Works, or any part of the Site, to train, fine-tune, test or evaluate any machine-learning or artificial-intelligence system, to clone or imitate the voice or style of the performers, or for text-and-data mining. We expressly reserve these rights, including under Article 4(3) of the EU Directive 2019/790 and any similar law;
- scrape, crawl or access the Site by automated means, other than ordinary search-engine indexing;
- bypass, disable or interfere with any access control, including password-protected pages, or share a password with others;
- remove or alter any copyright, attribution or other notice, or present the Works as your own.
5. Licensing and permissions
We are happy to consider licensing requests (for example, sync, performance or sample licences). Please email info@bromboks.com with who you are, what you want to use, where, for how long and in which territories. Permission is only valid if given in writing and signed or confirmed by KnoXXsiC.
6. Copyright complaints and takedown
If you believe that something on the Site infringes your copyright or other rights, email info@bromboks.com with the subject “Copyright notice”. To help us act quickly, include:
- your name, postal address, email address and telephone number;
- a description of the work you say is infringed and of where it appears on the Site (page address);
- a statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent or the law;
- a statement, under penalty of perjury, that the information is accurate and that you are the rights holder or authorised to act for them; and
- your physical or electronic signature.
This process is designed to meet the notice requirements of the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)), section 77 of the South African Electronic Communications and Transactions Act 25 of 2002, and comparable notice-and-action rules in other countries (such as Article 16 of the EU Digital Services Act). We may remove or disable access to disputed material while we review a notice, and may share the notice with the person who supplied the material. If you believe material was removed by mistake, you may send a counter-notice with the equivalent details. We may end access for repeat infringers.
Knowingly making a false copyright claim can carry legal consequences.
7. Private and preview pages
Some pages are password-protected while works are still being edited. They are private previews, not public releases. Access is personal and may be withdrawn at any time. Content on them may change or be removed without notice.
8. Third-party links and services
The Site may link to or load resources from third parties (for example fonts). We do not control them and are not responsible for their content or practices. See our Privacy Notice for details.
9. Availability and disclaimer
The Site and the Works are provided “as is” and “as available”. We do not promise that the Site will be uninterrupted, error-free or secure, or that the Works will suit any particular purpose. We may change, suspend or remove any part of the Site or the Works at any time.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of data, profit or goodwill, arising from your use of the Site. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for fraud, for death or personal injury caused by negligence, or any mandatory consumer rights you have where you live.
11. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law rules. This does not take away any mandatory consumer-protection or data-protection rights you have under the law of the country where you live. If a dispute arises, please contact us first at info@bromboks.com and give us 30 days to try to resolve it informally. Nothing prevents either of us from seeking urgent relief (such as an interdict or injunction) from a court of competent jurisdiction to protect intellectual property rights, in any country where infringement occurs.
12. Changes and general terms
We may update these Terms from time to time; the date at the top shows the current version, and continued use of the Site after a change means you accept it. If any part of these Terms is found to be unenforceable, the rest stays in force. These Terms, together with the Privacy Notice, are the whole agreement between you and us about the Site. If this page is translated, the English version prevails. Our failure to enforce a right is not a waiver of it.
